1. Introduction
Welcome to MiddleAxisPortal ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at middleaxisportal.site (the "Service") operated by MiddleAxisPortal.
By engaging with our Service or booking a yacht, you agree to be bound by these Terms. If you do not accept any part of these terms, you are prohibited from using the Service.
2. Service Overview
MiddleAxisPortal offers a range of high-end yacht charter services which include, but are not limited to:
- Rental of yachts on a daily basis
- Scenic sunset voyages
- Catered retreats for companies
- Private gatherings and celebrations
- Extended charters over several days
Availability of all services is conditional on current weather conditions. We reserve the right to alter or suspend our services at our discretion.
3. Booking and Reservations
3.1 Booking Process
When booking a charter, you must:
- Confirm that you are over the age of 18
- Supply information that is truthful and complete
- Submit the required deposit as indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking is only considered confirmed following our receipt of your payment and after we send you written confirmation. We reserve the discretion to decline service to any individual.
3.3 Availability
Charter bookings are dependent on the availability of vessels and favorable weather conditions. We intend to make reasonable efforts to meet your requested dates and times.
4. Payment Terms
4.1 Pricing
Quoted prices are in € and are inclusive of any applicable taxes unless stated otherwise. Prices may be subject to change without prior notice.
4.2 Payment Schedule
- Deposit: A payment amounting to 50% of the overall charter cost is due at the time of booking
- Balance: To be paid in full 48 hours prior to the departure of the charter
- Any additional fees (if applicable): Due following the charter's conclusion
4.3 Payment Methods
We accept mainstream credit cards, wire transfers, and certified bank drafts. Payment processing is conducted using secure, encrypted protocols.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Entire amount refunded, less processing charges
- For cancellations made 24 to 72 hours before departure: 50% of the payment is refunded
- Cancellation less than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
If our captain deems weather conditions to be unsafe, we will propose to:
- Reschedule your charter without extra cost to an alternative available date
- Issue a full refund if rescheduling is not an option
5.3 Mechanical Issues
In case there are mechanical issues with your allocated vessel, we will endeavor to source an appropriate replacement. If no replacement is available, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Adhere to all instructions from the crew
- Use the safety equipment supplied when necessary
- Inform us of any medical conditions which may impact their safety on board
- Stay within specified areas of the yacht
6.2 Prohibited Items
The following items are not permitted onboard:
- Containers made of glass
- Illegal drugs
- Weapons or firearms
- Excess amounts of non-alcoholic drinks
- Pets, except when pre-authorized
6.3 Conduct
Passengers are expected to behave respectfully. We reserve the right to conclude a charter early without a refund if the conduct of a passenger endangers safety or disrupts the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Liability for our services is limited to the value paid for your charter. We are not accountable for:
- Injuries sustained due to passenger misconduct
- Loss or destruction of personal belongings
- Indirect or punitive damages, or consequential losses
- Delays caused by weather or situations not within our control
7.2 Insurance Coverage
Comprehensive maritime insurance is maintained for our vessels and operations. Clients are responsible for arranging their own travel and personal insurance policies.
7.3 Assumption of Risk
By partaking in our charter services, you concede that activities at sea carry innate risks and you take responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
We hold the right to adapt itineraries, courses, or agendas due to weather, safety, or operational needs. We will strive to provide suitable alternatives when changes occur.
9. Force Majeure
We shall not be held accountable for any delays, cancellations, or alterations due to unforeseen circumstances, which include but are not limited to:
- Severe meteorological conditions
- Cataclysmic events
- Regulatory laws
- Harbor shutdowns
- Technical failures
10. Privacy and Data Protection
Your personal details are processed in alignment with our Privacy Policy. You authorize the use and collection of your information as outlined in our Privacy Policy by utilizing our services.
11. Intellectual Property
All material on our website, like text, visuals, trademarks, and photographs, is secured by copyright and propriety laws. You are prohibited from copying, distributing, or making derivative works without receiving our explicit consent.
12. Governing Law
The governing laws of Spain apply to these Terms. Any arising disputes will be addressed in the courts situated in Barcelona, Spain.
13. Changes to Terms
The right to revise these Terms at any moment is reserved by us. Notice of changes will be made public on our website, showing the effective date of the latest version. Your continued use of our services implies your acceptance of the amended terms.
